3. Facts found: Just after the Warning Signal, Brain Fade (windward) touched hulls with Groovy Grockle (leeward). Brain Fade took no penalty. Groovy Grockle protested in accordance with rule 61. Decision: There was a foul since Brain Fade broke rule 11, but the foul occurred before Brian Fade and Groovy Grockle were racing. The pre-amble to Part 2 of the RRS says that "a boat not racing shall not be penalized for breaking one of these rules, except rule 24.1". Protest disallowed. No penalty turns required. |
