22. Facts found:  On a beat in a moderate breeze, Olivia's Ostrich was sailing along on port tack to windward and astern of Reef Not who was also on port tack. Reef Not collided with Jacob's J who was on starboard tack. Reef Not came out of this collision on starboard tack. 

Jakob's J told Reef Not to do a Two-Turns Penalty but the latter did not. However, Olivia's Ostrich did lodge a valid protest about the incident. 

Decision: Reef Not is disqualified under rule 10

The clarification about rights asked for by Olivia's Ostrich is that all boats racing maintain all their rights except while:

  • returning to re-start
  • doing penalty turns

 

Thus OO was right to keep clear of RN who held right of way under rule 10.
