39. Ignominious Eagle is rapidly overtaking Comic Comet. As Ignominious Eagle attempts to pass about three lengths to leeward of Comic Comet,  the latter bears away slightly but definitely in an attempt to block some of Ignominious Eagle's wind. Can he legally do this?
