the crudity of my drawing.

We
were
finishing on a beam reach and we were the leeward boat carrying the big
red assymetrical kite, whereas the windward boat had gone to white
sails.
We were overtaking, had established our overlap from clear astern and
were
about 3 meters from the windward boat.
At this
point the windward boat bore away suddenly, forcing us to come off
rapidly
to avoid contact and collapsing our chute, allowing the windward boat
to
accelerate and finish ahead of us.
We didn't
protest because my skipper said we didn't have "luffing rights" since
we
had established the overlap from clear astern. I think my skipper
is wrong... even if we couldn't luff him, could he sail down on us like
that?
Could
we have protested successfully?
