If Starboard changes course so close to Port that the latter can no longer keep clear with a seamanlike manoeuvre, then starboard has infringed Rule 16. The distance apart will depend on boat speed and the angle and speed at which port and starboard are converging and would be a judgment call by the protest committee. The way the new Rules are written - with the increased emphasis on reducing confrontations and collisions - I expect that a good committee would lean towards accepting the word of the port boat if there was a case where the basic facts were agreed.
